Subcontractor workers’ comp exemptions

A subcontractor’s workers’ comp exemption is not a blanket approval for everyone they bring to a job. Check who the exemption applies to, whether it is current, and whether your contract accepts it.

Ask what “exempt” means

A sub may mean that an owner is excluded from a policy, that state law does not require coverage in their circumstances, or that they hold an official exemption. Those are different answers.

Ask for the basis and supporting record. Do not create your own exemption by having the sub sign a generic “no employees” statement.

Check the state and the people

Use the state workers’ compensation agency directory to find the applicable rules. For example, Florida DFS describes exemptions for eligible owners themselves. It does not treat that document as insurance for a whole crew.

1. Match the named person and business.
2. Check current status and any stated end date.
3. Ask who will actually perform the work.
4. Identify employees, helpers, or another subcontractor joining them.
5. Have your insurance adviser resolve any coverage question.

Check the contract too

A legal exemption does not necessarily satisfy the insurance requirement you agreed with the owner or subcontractor. Route conflicts to the person responsible for the contract before mobilization.

For example, a solo owner submits exemption evidence. A week later, two helpers arrive. That change should reopen the review, even if the original document has not expired.

Keep the decision specific

Record the evidence reviewed, the accepted scope, the approver, and any conditions. Recheck when the business, crew, location, or exemption status changes.
